AHALI Dispute Resolution is pleased to announce that it is working with the British Institute of International and Comparative Law on a study examining issues of state responsibility in the context of international investment law. 

This partnership reflects AHALI's commitment to advancing rigorous legal scholarship and fostering dialogue on some of the most pressing challenges in international law. As international investments continue to grow in complexity and scope, questions surrounding state conduct, investor protections, and the balance between public interest and private rights have become increasingly prominent. 

The study will therefore adopt an empirical approach to examining how the International Law Commission’s Articles on State Responsibility for Internationally Wrongful Acts (ARSIWA) are applied in investment arbitration. It will analyze trends over time, including which provisions are most frequently invoked, how they are used by both States and investors, and how tribunals have interpreted them in awards. By assessing patterns across different sectors, regions, and legal instruments, the study aims to identify whether tribunal practice is converging or remains fragmented, and to provide deeper insight into how state responsibility is interpreted in contemporary investment disputes.
