General Standards: In evaluating conflicts and making disclosures, Mr. Ali is guided by the standards and requirements set out in the American Bar Association’s Code of Ethics for Arbitrators in Commercial Disputes (2004); the International Bar Association’s Guidelines on Conflicts of Interest in International Arbitration (2004); and the UNCITRAL Code of Conduct for Arbitrators in International Investment Dispute Resolution (2024).

Prior Law Firm Affiliation: As of 1 January 2025, Mr. Ali no longer has access to the databases of his prior law firm, Dechert LLP, and is unable to request that firm to conduct conflicts checks. In addition to the matters and projects listed on this website and in Mr. Ali’s professional biography, over the course of his 35-year career as a lawyer, Mr. Ali was also involved in client matters in an advisory or supporting capacity. While such matters are not listed at this site, Mr. Ali will consider his involvement in any such matters for conflicts check and disclosure purposes.

Professional Activities: Mr. Ali is actively involved in the international arbitration community, is a member of several professional organizations and bodies, Mr. Ali’s conflicts checks do not include the members, officers, staff of these organizations and bodies, although he will undertake such a check upon request.

Academic Affiliations: Mr. Ali has teaching or academic affiliations with several law faculties. His conflicts checks do not include the faculty members, administrators and employees of these institutions, although he will undertake such a check upon request.

Speaking Engagements and Conferences: Mr. Ali attends many conferences and events. He does not maintain records of fellow members, speakers, panelists, students, faculty, participants or attendees and does not include them in his conflicts checks.

Social Media: Mr. Ali is active on LinkedIn. Any contact linkages in this regard should not be considered relationship that might affect his impartiality or independence in the eyes of a reasonable third party. “Likes” or other emojis to posts similarly should not ordinarily be considered as giving rise to doubts regarding Mr. Ali’s impartiality and independence.  

Investor-State Arbitrations: Mr. Ali continues to serve as a legal representative in some investor-State arbitrations, including arbitrations brought pursuant to the Energy Charter Treaty. These matters typically would not involve the same measure, the same or related parties, or the same provisions of the same instrument of consent as those for a prospective appointment. (Article 4, UNCITRAL Code of Conduct for Arbitrators in International Investment Dispute Resolution (2024)). Mr. Ali will consider any such relationship between a prospective appointment and his matters as legal counsel for conflicts check and disclosure purposes.

Party Responsibilities: Mr. Ali requests any party in a matter for which he is proposed as an arbitrator or neutral to disclose promptly any facts or circumstances considered relevant to his impartiality or independence as soon as that information is reasonably available and, for that purpose, to undertake a reasonable continuing search of publicly available information promptly after learning of his prospective appointment.

Assistants: In his work as a sole, presiding or party-appointed arbitrator, Mr. Ali is assisted by associate attorneys and paralegals at AHALI Dispute Resolution. These individuals perform the tasks traditionally performed by “arbitral secretaries,” including scheduling, file management and organization, legal research, coordinating hearings, preparing drafts of and disseminating correspondence, preparing drafts of procedural orders and histories, drafting of non-dispositive parts of awards. Mr. Ali’s assistants have no decision-making authority in any cases in which he serves as an arbitrator. All work is reviewed by and conducted under the direct supervision of Mr. Ali.
